Naturalization

Unless you’re a U.S. citizen by birth, you will have to attain citizenship through an immigration route known as naturalization. Generally, an individual must meet the following criteria to apply for naturalization: ➤ Be at least 18 years of age at the time you file the application; ➤ Have been a lawful permanent resident for the past three or five years (depending on which naturalization category you are applying under); ➤ Have continuous residence and physical presence in the United States; ➤ Be able to read, write, and speak basic English; ➤ Demonstrate good moral character; ➤ Demonstrate  knowledge and understanding of U.S. history and government; ➤ Demonstrate loyalty to the principles of the U.S. Constitution; and ➤ Be willing to take the Oath of Allegiance.

VAWA

VAWA, or the Violence Against Women Act, constitutes a visa category aimed at alleviating the suffering of survivors of domestic abuse. Under this provision, victims are entitled to legal status in the United States, along with employment authorization and access to public benefits, regardless of the assistance of the abusive U.S. permanent resident or citizen, provided they meet the qualifications. It's important to note that VAWA isn't exclusively for women; it extends protection to both men and women who are married to U.S. citizens or Green Card holders, as well as to children and stepchildren of U.S. citizens and Green Card holders, and parents of U.S. citizen sons and daughters who are 21 years of age or older.

Adjustment of Status

Adjustment of status is the process of applying for U.S. legal permanent residency from within the U.S. There are a few different scenarios when one can do so.

Reentry Permit

If you are a permanent resident who is looking to remain out of the U.S. for a prolonged period, you need to explore the consequences that could affect your permanent residency status. In some cases, applying for a reentry permit might cure the presumption of abandonment of permanent residency.

Asylum

Asylum is a form of protection granted to individuals who have fled their home countries due to persecution or a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. To qualify for asylum, applicants must demonstrate a credible fear of persecution if they were to return to their home country. Asylum seekers can apply for asylum affirmatively with the United States Citizenship and Immigration Services (USCIS) or defensively if they are in removal proceedings before an immigration judge.

Removal of Conditions

Beneficiaries of two-year green cards received through marriage must complete this process to have their conditions removed to become permanent residents. If you have gotten a divorce or experienced extreme cruelty during your marriage, you might still be eligible to remove your conditions under one of the waivers.

Refugee travel document
